New legislative changes in cash payments

Starting next year, we will not be able to pay more than 5,000 lei in cash, and from 2025 this ceiling will drop to 2,500 lei. Moreover, starting next year, companies are not allowed to end a day with more than 50,000 lei in cash. If the amount is higher, the authorities may reține 25% of the amount.

Fiscal changes assumed by the Government impose a ceiling on cash payments that individuals can make to merchants: for amounts greater than 5,000 lei, Romanians will have to use the card. This measure aims to reduce tax evasion in order to supplement the amounts that enter the state budget.

The cash collection and payment operations carried out between the persons provided for in art. 1 paragraph (1) and natural persons, representing the consideration for deliveries or purchases of goods or services, dividends, assignments of claims or other rights and receipts or refunds of loans or other financing are carried out within the daily ceiling of 5,000 lei to/from one person, until December 31, 2024 and 2.500 lei, starting on the 1st January 2025

The new article provides that the cash amounts in the cash register of the companies they will not be able to exceed, at the end of each day, the ceiling of 50,000 lei.

Failure to comply with the provisions constitutes contraventions and is punishable by a fine of 25% of the amount collected/paid, respectively held in the cash register, which exceeds the ceiling established by this chapter for each type of operation, but not less than 500 lei”, according to the fiscal changes, companies will be able to make cash payments to each other of a maximum of 1,000 lei per day.

If you are an economic operator, PFA or any other authorized category, which issues invoices, then you will have to limit cash payments to another economic agent to a maximum of 1,000 lei per day, respectively 2,000 lei per day in cash&carry stores.

„(1) By exception to the provisions of art. 1 paragraph (1) cash collection and payment operations can be carried out, under the following conditions: a) collections from the persons provided for in art. 1 paragraph (1), within a daily ceiling of 1,000 lei from one person; b) collections made by cash and carry stores, which are organized and operate based on the legislation in force, from the persons provided for in art. 1 paragraph (1), within a daily ceiling of 2,000 lei from one person, it is also shown in the changes package.
