What is Form F4105?
According to ANAF, the reference to Form F4105 is "Notification regarding the status of the electronic fiscal marking machine" (https://static.anaf.ro/static/10/Anaf/Declaratii_R/4105.html).
In the case of the F4105 form, notification is required regarding the following situations where electronic cash registers are found:
- changing the location of use of AMEF, depending on the work points that the economic operator owns. It is necessary to notify the competent body regarding the change of location within 5 days of the occurrence of the change;
- situations of theft of the electronic fiscal marking device;
- situations of loss or damage to the cash register (or other types of its alienation);
- situations aimed at closing the work point where the electronic marking device was located;
- situations aimed at stopping the activity of an economic operator: dissolution of the company, liquidation, etc. In any of these cases, it is necessary to submit the F4105 form regarding the notification of the competent authorities regarding the situation of the electronic fiscal marking machine.
When must Form F 4105 be filed?
According to the specifications of the National Tax Administration Agency, the F4105 form must be submitted within a maximum of 5 (five) days from the date of occurrence of any of the previously exposed situations. It is important to note that failure to submit the F4105 notification on time constitutes a contravention and is penalized in accordance with the legal provisions.
The form can also be submitted by electronic means of submission, but it is necessary to use the digital signature of the legal representative of the company.
